W opracowaniu przedstawiono problematykę wszczęcia i prowadzenia postępowania nakazowego jako jednego z cywilnych postępowań odrębnych. Analizę przebiegu postępowania nakazowego, jako jednego z postępowań przyspieszonych, poprzedzono krótkim rysem historycznoprawnym. Następnie omówiono wspólne regulacje prawne dotyczące wydawania nakazów zapłaty w postępowaniu nakazowym oraz upominawczym. Szczegółowo opisano odmienności postępowania nakazowego, w tym podstawy do wydania nakazu zapłaty, jak również środki zaskarżenia przysługujące pozwanemu od wydanego nakazu zapłaty.
The study presents the issues related to the initiation and conduct of summary proceedings as one of the civil separate proceedings. The analysis of the course of summary proceedings, as one of the expedited proceedings, is preceded by a brief historical and legal outline. Subsequently, the common legal regulations regarding the issuance of payment orders in both summary and order-for-payment proceedings are discussed. The differences of summary proceedings are described in detail, including the grounds for issuing a payment order as well as the means of appeal available to the defendant against the issued payment order.
